Training Services Agreement

The parties agree as follows:

Liability: Dog Owner acknowledges that Affinity Dog has no control over the Dog when the Dog is not in the exclusive custody, care and control of Affinity Dog, and Owner agrees to indemnify and hold Affinity Dog harmless from and against any and all claims of injury, expense, costs, loss or damages caused by the actions of the Dog when the Dog is not the sole custody, care and control of Affinity Dog. Dog Owner acknowledges and agrees that owning any animal, including the Dog, has inherent risks, including but not limited to the risk of dog bites to Owner.

At Trainer's sole election, Trainer's duties shall terminate if (a) in Trainer's sole judgment Dog is to dangerous or vicious to Trainer or any other person or animal, or interferes with the training of other dogs, or (b) Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, Trainer's duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.

NOT Liable for Dog's Performance.
Although Affinity Dog will use all reasonable care to train owner’s dog, Affinity Dog cannot guarantee that owner will ensure that the dog will respond adequately to commands at all times. Owner agrees that Affinity Dog will not be liable for any damage or loss resulting from the dog’s failure to respond to any command(s) or behavior modification for which Affinity Dog trained the dog.
Affinity Dog agrees to train Owner's dog in a reasonable manner. However, the effectiveness of the completed training program depends upon many factors over which Affinity Dog has no control. Such factors include, but are not limited to: the future health of the dog, the frequency and effectiveness of training reinforcement, which the Owner must give the dog, and the degree of respect that the Owner instills in the dog.
Should the dog injure any person, or should the dog’s failure to respond to any commands(s) result in damage to any property or any person (including the Owner), Owner agrees to absolve Affinity Dog from any and all obligations and to pay any such damage to such person. Owner further agrees to hold Affinity Dog harmless from any and all such claims.

This contract for Training Services supersedes all other agreements, written or oral, previously made between Client and Trainer.

I hereby assign and grant to Affinity Dog the right and permission to use, reproduce, distribute, and publish the photograph(s), film(s), videotape(s), audio and video recording(s), electronic representation(s) and/or sound recording(s) made of me and/or my dog(s) at any time during the training and/or boarding of my dog(s) by Affinity Dog, and I hereby release Affinity Dog from any and all liability resulting from such use, reproduction, distribution, and publication.

I hereby authorise the reproduction, sale, distribution, copyright, exhibit, broadcast, and/or electronic storage of any and all such photograph(s), film(s), videotape(s), audio and video recording(s), electronic representation(s) and/or sound recording(s) without limitation at the discretion of Affinity Dog and I specifically waive any right to any compensation I may have for any of the foregoing.
